			<content:encoded><![CDATA[<p>Apparently our judges have forgotten what little they once knew about the constitution, are we even living in the US anymore?</p>
<p>The Tenth Amendment (Amendment X) to the United States Constitution, which is part of the Bill of Rights, was ratified on December 15, 1791.</p>
<p>The Tenth Amendment restates the Constitution&#8217;s principle of federalism  by providing that powers not granted to the national government nor prohibited to the states by the Constitution of the United States are reserved to the states or the people.<br />

<p>As well please find some case law also from the wiki site, which is good reading for those judges that are too ignorant to understand case law. </p>
<p>It is amazing that we have one person that decides to over rule more than a decade of case law which is clear. </p>
<p>History and case law</p>
<p>The Tenth Amendment is similar to an earlier provision of the Articles of Confederation: &#8220;Each state retains its sovereignty, freedom, and independence, and every power, jurisdiction, and right, which is not by this Confederation expressly delegated to the United States, in Congress assembled.&#8221;[1] After the Constitution was ratified, some wanted to add a similar amendment limiting the federal government to powers &#8220;expressly&#8221; delegated, which would have denied implied powers.[2] However, the word &#8220;expressly&#8221; ultimately did not appear in the Tenth Amendment as ratified, and therefore the Tenth Amendment did not amend the Necessary and Proper Clause.</p>
<p>The Tenth Amendment, which makes explicit the idea that the federal government is limited only to the powers granted in the Constitution, is generally recognized to be a truism. In United States v. Sprague (1931) the Supreme Court noted that the amendment &#8220;added nothing to the [Constitution] as originally ratified.&#8221;</p>
<p>States and local governments have occasionally attempted to assert exemption from various federal regulations, especially in the areas of labor and environmental controls, using the Tenth Amendment as a basis for their claim. <p>That is right you were executed, often without any ceremony at all. </p>
<p>It was really easy, if a roman soldier came up to you and asked you the question, then you said yes, I pledge myself to the roman empire, if you failed to do so, yes, they killed you.</p>
<p>While things may not be so brutal now days, it is no surprise that men are still expected to pledge allegiance.</p>
<p>We believe in America, We believe in the Flag, We believe&#8230;</p>
<p>This is what it is all about, if you dont agree, why dont you just get out.<br />
that may sound hard, but if you cannot agree, that those simple words are words that we all as Americans must live by after millions of americans have given their lives, blood and tears to defend this great nation from those that would dismantle it, then I have no use for you. </p>

<p>Are we throwing the rule book out the window along with all of our history?</p>
<p>One has to wonder, if you dont have to have any practical experience, in being a judge&#8230;</p>
<p>Then what is next will we have a painter being nominated to the supreme court, in some ways, you have to ask is this an insult to all of America, it just seems like bad decision after bad decision, now we have the first nomination to the supreme court and they have no experience at being a judge. </p>

<p>Rumors, abound and are speculation at this point, but many feel that if pressure from the current administration, which is not friendly to business, allegedly, that is not union, allegedly, </p>
<p>The first thing that needs to be done here is to clear the air, because everyone has been calling this an oil spill and that is not accurate.</p>
<p>It is a leak, and a man made one at that&#8230;</p>

<p>Oil spill lawsuits, have you been effected?   There are indications that the amount of money being spent, on advertising, is allegedly more than what is being spent on helping the people who are unable to make a living due to the oil spill. </p>
<p>No one knows for sure, and if that is true why not?</p>
<p>Why are they not doing all they can to really stop this thing, it is common to spend big bucks on a PR, image campaign, while spending less to fix the problem, just look at Toyota, allegedly spending a huge sum of money to enhance image and PR, while not doing much allegedly for the customer. </p>
<p>It seems like the corporate thing to do, the only thing missing from the recent ad was a tear slowing streaming down his face, amazing stuff I know, I am not convinced that they are doing all they could be doing, allegedly. </p>
<p>So what is up with this kind of stuff, we have a company that could be doing more, but it seems like they are not doing all they can.</p>
