The first thing that needs to be done here is to clear the air, because everyone has been calling this an oil spill and that is not accurate.

Oil spill lawsuits, have you been effected? There are indications that the amount of money being spent, on advertising, is allegedly more than what is being spent on helping the people who are unable to make a living due to the oil spill.
No one knows for sure, and if that is true why not?
Why are they not doing all they can to really stop this thing, it is common to spend big bucks on a PR, image campaign, while spending less to fix the problem, just look at Toyota, allegedly spending a huge sum of money to enhance image and PR, while not doing much allegedly for the customer.
It seems like the corporate thing to do, the only thing missing from the recent ad was a tear slowing streaming down his face, amazing stuff I know, I am not convinced that they are doing all they could be doing, allegedly.
So what is up with this kind of stuff, we have a company that could be doing more, but it seems like they are not doing all they can.
Do you have credit cards? Are you in debt, then you need to fully understand the way this thing works…
Recently the president signed into law a whole new set of rules for credit card companies, many are saying that it is very unfair to those people who have good credit, however, it seems only logical that the credit system is basically broken as it is and this new law does nothing to help.
The new credit laws, do not really do much to help the consumer as it allow the credit card companies to penalize those people who pay their bills on time.
The problem here is that people that have credit cards and dont really need them will not pay for service fees and extra fees.
They will just terminate them with prejudice.
It is the old adage, those who need credit, cant get credit and those that dont need credit can get all they want and more.
Does this make any sense at all?
No, actually it does not make any sense at all, however these companies will do just that, they will start out sending out increases in fees annual fees and more.
Which will result in consumers just canceling the card and paying in cash.
After all they dont need the credit, it is just those people that need credit that will pay the fees, so how is this going to help the market?
The answer is that it will not help the market at all.
It is just another law that is not needed and will cause problems down the road.
Just wait and see…
I just have one thing to say, Training, Training Training, we need more of it, Police officers have the toughest job dealing with civilians, and it is not easy, they are human, and as such subject to making mistakes, better training will help stop these lawsuits, there is no reason for this…
What is Tort anyway… it may sound like a dessert, but it is not…
Tort can be defined as
any wrongdoing for which an action for damages may be brought, generally you can bring a lawsuit for anything…
This is a no brainer, really, it is good for the insurance companies, and it is good for frivolous law suits, really no self respecting attorney would or even should be caught dead filing a frivolous lawsuit…
We need this in order to make health care reform work, without it, you can forget it..,
Tort Reform is needed, in fact it is something that is mandatory if we are going to find a path way to a good future.
Almost 70 percent of small business want tort reform in the health care bill yet, so far nothing…

You might wonder, if they understand it at all, for those who payed attention in civics, class, they call it a balance of power for a reason.
You would think that perhaps they have not, there is a reason the founding fathers made the constitution so that no one branch of power would have complete control over the government, it is the reason after all that we became a nation separate from where we came from.
Are they stupid?
Are they insane?
Are they Nuts?
Has the EPA as some suggest over stepped it boundary of power, by intentionally misinterpreting, a supreme court ruling?
Many fear that the EPA may make a serious mistake by trying to become a dictator?
What, no way the EPA would try something as stupid as that right, well some people think the supreme court makes policy.
What Again no way…
Because the supreme court does not make changes to the constitution.
So, consider that, Mr. EPA because the constitution says that you do not have to power to enforce your rule over America.
Rumors abound about lawsuits that will be filled soon against the EPA should they attempt to take over the Government by enforcing a mistaken ruling by the Supreme court, because the constitution is still the rule of law and even the supreme court does not have the right to supersede the constitution.
As well were you to ask the opinion of the Supreme court you would find that they never intended the EPA to attempt to enforce the ruling they made in the way they have interpreted it, In fact some argue that even now the court would hear a brief on the matter and rule accordingly.
So all you constitutional lawyers and scholars out there, step up to the plate, because it is time to make a name for yourself.
Warning this is a sad story, but it is a story that needs to be told.
Is there no justice any more? Can you be a judge and still make this kind of mistake?
What? No way, this is an outrage, that a judge in texas can make a ruling without any type of followup or even making a single phone call? Something is really bad wrong in the state of texas… Police forced the boy into the custody of his father and as it turned out, it was a really horrible mistake, You just have to wonder, what were they thinking…
You see the coverage and you see the boy, should not there have been some type of alarm bell going off in the minds of the police, they have no problem, disrupting, the lives of thousands of other texans, but when it comes to some low level judge suddenly, there can be no questions asked?

In texas the police can pull a frightened and obviously terrified boy who did not want to go with his father, but when it comes to fighting real crime…
Sort of makes you wonder what is going on in the law enforcement community…
Naturally, we understand that this an exception to the rule and we know that, but it just really makes you mad to watch how often the police get it wrong, and how often they could just use some common sense and there could be a very different result.
So really what is going on with this type of enforcement, you see how often people are going to jail for non violent crimes, while certain areas of most large cities, ( the south usually) are no fly zones.
Could it be that it is easier to pick on non violent suspects than to go after those gang banging buddies.
Could it be that it is safer to go after someone with a parking ticket than to go after a drug dealer?
Could it be that is is easier to take a child away from his mother than to make a phone call first?
You just have to wonder and you know it is a tough job, sure everyone understands that, but if they are going to do the job can they not do it the right way?

Over this next judicial season, we are sure to see some history making case law coming forward for consideration both to the supreme court and in other litigation, tort reform is certainly part of that sensational history history in the making, even the most jaded of professionals cannot help but admit that tort reform is needed, however, the main issue is how to reform in a fair way?
In one way, large companies, can how weigh the law of averages against, doing the right thing, they can decide to let a failure continue knowing that they will not have to pay the price through litigation.
This is certainly a problem that should be considered even more so is the very real effect of frivolous law suits on this industry.
So punishment should be commensurate with the offense, as well as the ability of the offending party to provide a remedy…
Knowing there are two extremes here and finding the right balance between those two extremes will be the true test.
Why do you suppose that so many people are in jail on drug use related charges, well I can tell you one reason, why, allegedly, it is easier to pick on people who are defenseless, they are easy to put in jail, they usually do not resist, and there is little or no danger to the officer.

was asked a question about why we did not have any litigation in all these constitutional issues that appear to be taking place with the current administration, he never answered the question in stead he just ignored it, I have to wonder why the vaunted verbalist, choose not to answer the question and why?
One thing for sure, when the ACLU attempts to file a lawsuit the WH appears to feel the need to immediately comply.

You fight fire with fire, since congress is determined to trample on the constitution of these United states of america, then someone should be standing up for the constitution, like attorneys, for instance.
So what is going on are we no longer under the constitution?
