unreal but is it true? Can it be that we are looking at criminal actions.

This just in there is quite a lot of news happening on the computer front, while some are saying that this is unconstitutional use and abuse of power others are saying it is hacking? Who is right, and who is wrong, this was received via email and may or may not represent the opinions of this news company. (alleged news company)

What can we do to keep those that are ignorant of technology from creating laws that threaten our freedom?

It’s been a crazy 24 hours. Former Demand Progress executive director Aaron Swartz was arrested yesterday for allegedly downloading academic research articles from JSTOR.

More than 35,000 people have already signed a letter of support for Aaron. Will you join them by clicking here?

The mainstream coverage of the arrest has turned in Aaron’s favor — and the outpouring of support for him is a key part of the story. Here’s a sampling of the coverage:

BOSTON GLOBE: By yesterday afternoon, however, Swartz had received an outpouring of support from colleagues and friends who took to blogs and websites to defend his work and maintain that the charges against him are heavy-handed. More than 15,000 people had signed a letter of support for Swartz on the website Demand Progress.org

HUFFINGTON POST: JSTOR’s the one that should be in prison, man, for locking up knowledge.

NEW YORK TIMES: A respected Harvard researcher who also is an Internet folk hero has been arrested in Boston on charges related to computer hacking, which are based on allegations that he downloaded articles that he was entitled to get free.

AMERICAN PROSPECT: It’s easy to forget that there’s something at all controversial or oppositional about accessing information, or that some people really, really want data to be free — and others don’t. Open data has been mainstreamed. Whatever hacker-culture roots the free information movement might have are subsumed by the idea that simply everyone agrees that data is meant to be free, and the struggle is over the mechanics of freeing it. That’s never really been true, as Swartz’s case makes plain.

BOSTON GLOBE: [Attorney Jerry] Cohen said the use of criminal charges here is the latest in what has been a government trend to prosecute such cases, which he described as taking “a sledgehammer to drive a thumb tack.’ ‘It might be taking too big a weapon,’’ he said. “It’s intended to terrorize the person who’s indicted and others who might be thinking of the same thing.’

As the case proceeds, we remain hopeful that Aaron will be cleared of any wrongdoing — and as has been proved over the last 24 hours, the more people learn about the case, the more sympathetic they become to Aaron’s cause.

Please show your support for Aaron by clicking here to sign our petition — it will only take a second.

Thanks so much for your support as we navigate these choppy waters.

— The Demand Progress team

P.S. Please make sure your friends are aware of Aaron’s predicament by forwarding them this email or using these links:

Did this just happen?

Did a Judge just Block the US constitution, in a case of the State of Alabama and its legal right under the constitution to pass and legislate, laws which is guaranteed by the Tenth Amendment to the Constitution, this is legal and the judge should know this yet, the judge took steps to attempt to block the tenth amendment to the constitution.

That my friends is a scary thing, because we know that this is not the American way, the American way is based on the constitution, it has been very well for the United States for over two hundred years.

This makes you wonder what kind of mentality would be required for a judge to make a ruling like this one, what kind of narcissism would be required for one man to rule that the will of the people be damned?

One man would be dictator to 300 Million people is that really the truth?

How is it possible?

When a man would ignore law in favor of personal opinion can that man apply legal principal to a case with real effectiveness?

When a man would be a dictator to the world how can that man ever be trusted to be a man of the will of the people or the will of the law?

How can the people trust the legal system when one man is willing to do things such as this at the bidding of his masters in Washington?

When politics dictate the motions of the law then all mankind looses.

When politics over rides the legal system then all the world is at risk.

When politics defeats the natural course of the will of the people then no one can ever be free again…

Will this judge be the dictator of the world?

Will this judge be ruled over by those in power?

Will this judge make up rules as he goes along?

Is this judge fit to be serving at all?

The answer here is clear, (allegedly) this man is unfit…

Over the last few months the trial of Casey Anthony was a great demonstration of how not to prosecute a case.

You saw evidence submitted that was not even scientifically sound, (an electronic sniffer gadget) which is based on some pretty shaky, scientific ground, it has been used effectively for detecting criminal actions, like the presence of carbon based substances, however, the way it was used here, not good, not accurate, and most of all, probably not a good fit for the case.

Then you look at the State of Florida, they could have got Casey Anthony for Manslaughter, she would still be in jail and likely for a long time, 5 six years or so, but they wanted to put her to death, the problem was that they also had no direct evidence linking her to a crime.

They did not have any evidence that showed the infant died in any particular way, accidentally or otherwise, they could not really say one way or the other, oh they tried, to say it was on purpose, but that was just not believable, because in cases that involve a first person murder of a child, it is almost always a man that is the person responsible, statistics, prove this out, time and time again, (allegedly) yet the media including bill orielly wanted to see a conviction and likely a televised, (allegedly) event, of an execution, but that really was never going to happen because again, you cant go around putting people to death without any direct evidence of a crime.

So, the state of Florida ended up spending huge amounts of money, on this trial, they ended up with nothing but lying to officers, (debatable, because she allegedly was never handled properly by investigators, another black mark on the state of Florida) you would think that the state would be happy to be done with this circus of a trial, and the ignorant methods that law enforcement attempted to prove a case that they could never prove beyond a reasonable doubt.

Yet, now a judge, (and can I say this guy is not really judicial at all) (allegedly)

Wants her to come back to the state of Florida and serve a one year probation where the state of Florida will likely have to pay well over 150,000.00 for security to make sure that this probationer is not murdered in the state of Florida while serving a petty probation sentence, really, that is just laughable, what kind of judges do they have in Florida anyway.
I know I know, its FloriDUH

Home of the swinging chad among other things, considering the tourism aspect of this situation you might thing the state would be well rid of such a case and its ugly reminder of how stupid the state was in its over zealous prosecution, (again allegedly)

I just find this truly a fantasists dream come true, I hope they can keep her safe, because if they do not keep her safe, then before they can have a funeral, the Antonies, will file a multi million dollar suit against the state of florida the judge, and anyone else that might be blamed for their daughters death never mind that she might be a slut, or what ever, (allegedlly,) got to be fair right, )

Because if some wacko, gets to her, and just manages, to assault her, the State of Florida will be responsible for millions in damages, why?

Simple, it was preventable, they did not have to do this, they could have just come in and let it go, (dumb judge or not) because lets face it before this that judge never saw so many cameras pointed at him and likely he liked it, (allegedly)

this is not going to end well mark my words here, the state of Flordia, (tax payers, if you please) are going to have to foot the bill for this deal, better to just let it go…

The end is the end, you lost take you lumps, and eat your peas, its over.

Federal Judge Rules Florida Drug Law Unconstitutional

ORLANDO, Fla. There are a number of things that may need to be adjusted in Florida, considering that they have had the tendency to over charge cases in the past most notably the Casey Anthony, (alleged accidental or negligent death, of her child) they attempted to get a death sentence, when manslaughter would have been a more appropriate charge.

So it should come as no surprise that the state of Florida has been engaging in (allegedly)
improperly charging cases, so A federal judge has struck down a Florida drug law that convicts suspects of a drug offense even if they are unaware that the controlled substance is illegal.

U.S. District Judge Mary Scriven found the 9-year-old law unconstitutional in a decision Wednesday and called for the re sentencing of Mackle Shelton, who had faced 18 years in prison.

It seems like this would be a common sense issue yet you just cant seem to get the right feel for what the State of Florida is really up to in its dependence upon allegedly unlawful prosecution of people who may not be guilty of any offense at all.

Homeschooling Laws – What You Should Know before you make decisions about your child’s education.

Your legal situation as a home schooler depends largely on what state you live in and how state and local officials enforce the laws concerning compulsory attendance, private education, and homeschooling. Whether they require registration, a notice of intent, regular evaluation, or advance approval, the statutes take in your state can be less important than how they are enforced.

To keep your homeschooling legal worries to the minimal level they deserve, here are some things which you should bear in mind:

1. Know what your state’s law says. Read the applicable statutes for yourself, talk to other homeschoolers, and join a state homeschooling organization that monitors the regulations affecting homeschoolers.

2. Learn what potential problems for homeschoolers exist in your state. Learn how other homeschoolers have dealt with them successfully, and plan how you’d respond if faced with them yourself. Don’t wait until after the fact to learn what your options could have been.

3. Do not automatically assume that any explanation of home-schooling legal issues you hear or read is correct. Whether the opinion is that of a school official, a lawyer for a home-school legal defense organization, a legislator, or another homeschooler, you need to check it out for yourself. Laws concerning homeschooling are usually complex; clear and definitive statements on legal issues usually leave out something important.

4. Do not let worry about legal issues distract you from the everyday business of homeschooling. When homeschoolers object to rules that require them to document their children’s learning or to have their kids tested on a regular basis, it’s because such requirements often interfere with that learning. If you are changing your whole approach to homeschooling because of your state’s legal requirements, you are probably worrying way too much about the law.

5. Do not be shy about your homeschooling. You don’t have to announce it to everyone you meet, but visible home-schoolers help make homeschooling familiar and acceptable to the general public. With enough of us around, the, public may eventually understand that homeschooling can be fun and exciting, as well as effective, and we’ll find we
have active support even from families who would never home school themselves.
