<p>ORLANDO, Fla. There are a number of things that may need to be adjusted in Florida, considering that they have had the tendency to over charge cases in the past most notably the Casey Anthony, (alleged accidental or negligent death, of her child) they attempted to get a death sentence, when manslaughter would have been a more appropriate charge. </p>
<p>So it should come as no surprise that the state of Florida has been engaging in (allegedly)<br />
improperly charging cases, so A federal judge has struck down a Florida drug law that convicts suspects of a drug offense even if they are unaware that the controlled substance is illegal. </p>
<p>U.S. District Judge Mary Scriven found the 9-year-old law unconstitutional in a decision Wednesday and called for the re sentencing of Mackle Shelton, who had faced 18 years in prison.</p>
<p>It seems like this would be a common sense issue yet you just cant seem to get the right feel for what the State of Florida is really up to in its dependence upon allegedly unlawful prosecution of people who may not be guilty of any offense at all. </p>

			<content:encoded><![CDATA[<p>Does that make any sense, well I suppose if your the movie character Forrest Gump then yes it does, but for the rest of us who live in the real world, legal probability has for many years been the standard that is until the last five or so years when legal verdicts have become something akin to reading a palm you just do not know what will happen next, and that is where experience and negotiating skills come in to play. </p>
<p>These days, what might be law is not what occurs, in most court rooms, some Judges have taken to riding the Bench to develop law, which has given rise to many different types of legally offensive situations where one mans opinions have over ruled the majority of the people. </p>
<p>This was never meant to be, it is not constitutional and it is not good jurisprudence. </p>
<p>Yet, we see evidence of this perversion not only in our court systems, but also in our highest court, The Supreme, court, has over the last 20 years slowly begun a partisan approach to the interpretation of the law this is not only dangerous but it eroding what this nation was built upon.  </p>
<p>These days, the law is something that some people are playing fast and loose with considering the Duke case where, a man allowed his own personal opinion to create an incredible amount of liberality for both his profession and the town for which he worked for, it is not only disturbing to see this type of perversion of justice but it is becoming common place practice, forget about having any kind of real proof, none apparently is needed, they charge you and they can ruin your life, (allegedly) with no proof and unless you have deep pockets and a sense for justice you cannot prevail, as in anything in life if a man or a woman makes a mistake either in judgment or expression of personal proclivity, over common sense and the law, then that person should be made responsible for such damage as they bring to the public. </p>
<p>For the most part over the last 30 years, if criminal charges were brought against some one they were publicly presumed guilty, after all we trust our officials, but is that really the right thing to do?</p>
<p>In some ways, some seriously lacking legal pursuits have been brought before the people, it used to be a joke that you could get a ham sandwich indicted, in fact in a interview with an elderly woman who was in a grand jury some years ago, (not as long as you think) She related about how the prosecuting attorney would bring five cases at a time in front of the jury to vote upon. </p>
<p>Which was a serious concern to this lady and I can understand such concerns, as each should be carefully considered, not put before a group of tired senior citizens, of which several in the room were unable to read the written language, (no they were not illegal aliens) they were elderly senior citizens, and some of them were unable to read. </p>
<p>When you see this kind of thing happen in open court, and no one says a thing, you may see a few frowns when this kind of thing happens, but for the most part, people are afraid to say anything, because what if they found themselves being brought up on charges, true or not, you could end up loosing your house, your job, your life savings, all because of one corrupt individual. </p>
<p>So for the most part people remain silent, which is also disturbing, while you may watch the media and feel like you have all the facts, the truth is that news leaked to the media is very seldom accurate, which is another thing that is disturbing, the practice of trying cases in the media. </p>
<p>It is not fair it is often not accurate, but once it occurs do you really think that anyone will belive you are innocent after they get finished with you, you could find that along with everything else you have lost your good name as well as everything you own. </p>
<p>That should be the most disturbing thing of all. </p>

<p>What would happen if the largest retailer to the underprivileged and the poor had to increase their prices by 33 percent?  Use some common sense, people have to live and poor folks depend on low prices at walmart just to get by, most days, if folks could not save a few dollars each month shopping at walmart they could very well end up starving to death, all for what?</p>
<p>Is walmart going union, and will it cost thousands of people their jobs?  Amazing I know but that is what it appears, we have a company that is trying to tell walmart how to run its own business, what is up with that garbage, are they crazy or have they just been to the white house 22 times?</p>
<p>Allegedly, unions, have purchased, clout, and that is something that is dangerous. </p>
<p>What what next will they tell you how much pork you can eat, will it be hey you have already had bacon once this week and you know that we know what is best for you so you cant eat what you want to eat any longer&#8230;</p>
<p>I remember in my home town there used to be a large tire plant that employed hundreds of people in the local economy, they payed millions in taxes, and support local charities.</p>
<p>The Unions, allegedly said that they would go on strike if their DEMANdS were not complied with.<br />
The company said hey we can do a little but we cant do that, and if you go on strike then we will close the doors, the Unions allegedly went on strike and the company closed the plant and opened up in Mexico, (allegedly) leaving hundreds and hundreds of people out of work&#8230;</p>
<p>Excuse me but where is the ACLU when you need them, are they really helping america any more?</p>
<p>Or is it as some allege that that the ACLU has sold out to the left&#8230;</p>
<p>I think that it is time for the ACLU to stand up and protect the people like they claim they have done in the past, it is time to stand up and man up or woman up&#8230;</p>
<p>If you can file lawsuits against christians, then you had better file lawsuits against the opposing factions, fair play is fair play&#8230;</p>

<p>Is there no justice any more?  Can you be a judge and still make this kind of mistake?</p>
<p><strong>What? </strong>  No way, this is an outrage, that a judge in texas can make a ruling without any type of followup or even making a single phone call?  Something is really bad wrong in the state of texas&#8230;  Police forced the boy into the custody of his father and as it turned out, it was a really horrible mistake, You just have to wonder, what were they thinking&#8230;</p>
<p>You see the coverage and you see the boy, should not there have been some type of alarm bell going off in the minds of the police, they have no problem, disrupting, the lives of thousands of other texans, but when it comes to some low level judge suddenly, there can be no questions asked?</p>
<p>Insanity&#8230;</p>
<p>In texas the police can pull a frightened and obviously terrified boy who did not want to go with his father, but when it comes to fighting real crime&#8230;</p>
<p>Sort of makes you wonder what is going on in the law enforcement community&#8230;</p>
<p>Naturally, we understand that this an exception to the rule and we know that, but it just really makes you mad to watch how often the police get it wrong, and how often they could just use some common sense and there could be a very different result.</p>
<p>So really what is going on with this type of enforcement, you see how often people are going to jail for non violent crimes, while certain areas of most large cities, ( the south usually) are no fly zones. </p>
<p>Could it be that it is easier to pick on non violent suspects than to go after those gang banging buddies.</p>
<p>Could it be that it is safer to go after someone with a parking ticket than to go after a drug dealer?</p>
<p>Could it be that is is easier to take a child away from his mother than to make a phone call first?</p>
<p>You just have to wonder and you know it is a tough job, sure everyone understands that, but if they are going to do the job can they not do it the right way?</p>

<p>If you have been a victim of police our of control, take action, find a lawyer, One thing you should always remember, if you are stopped, do so in a well lit area, as long as you can safely do so without causing a problem, note that trying to go more than a few hundred feet will probably cause you a problem.</p>
<p>Try to find other people around most of the time, attacks will not take place in front of a witness. </p>

<p>This is crazy, in floriduh, go figure, but here is one situation where a man who was accused of possession of rolaids spent three months in jail, what a mess and there is something really crazy about floridah law enforcement.</p>
<p>One thing for sure you may want to re-consider your vacation to floriduh if they don&#8217;t get a hold of these problem prosecutors and law enforcement officers.</p>
<p>Anyone talking to this guy would know that he is not a drug user, yet, the justice system completely broke down in this instance, I just cant believe that no one was able to take a common sense look at this situation and understand that this guy was not a drug user.</p>
<p>Police have a hard job but come on folks this is getting out of hand, tourism in floriduh is going to suffer if t his kind of stupid stuff is not nipped in the bud, so to speak, This guy was obviously not a drug user and even if the police man made a mistake the ADA should have seen that this guy was not a user.</p>
<p>I know one thing there are thousands of people out there using rolaids and if police cant tell the difference then people and tourists in Florida are in for a rough ride.</p>
<p>So now what will happen next, well the state of Florida will pay a settlement and it will not be cheap, and that money will be tax dollars, People if this happens to you get a good lawyer, if this guy had a good lawyer to begin with none of this would have happened.</p>
<p>It is good to see that this guy now has a good lawyer. </p>
<p>If this ever happens to you, get a lawyer, for Gods sake, do not sit in jail over a bad lawyer.</p>

<p>Are we on the brink of insanity?</p>
<p>Recently we have seen some very unusual situations that defy the constitutional levity of america and<br />
Over the last few months we have seen some very interesting legal situations that have arisen, in fact in a recent supreme court decision, a lower court was handed its arse in a hand-basket.</p>
<p><strong>Legislation from the bench is not ethical nor is it constitutional.</strong></p>
<p>You have to wonder about these types of situations, because as it is so often taught in law schools, the law is in the words not the thoughts or feelings of the judges.</p>
<p>Many attorneys are starting to realize that there is a need to challenge the constitutional legality of some of the recent decisions that have been made by this present administration.</p>
<p>This is a very disturbing situation however, the supreme court will be hearing more as we go along because it is apparent that the constitution is being trampled on by the government and it will be up to the legal community to do the right thing here and the right thing is also going to be the legal thing.</p>
<p>Will you be one of those attorneys that challenge the constitutionality of these recent judicial activism decisions that are headed to the supreme court?</p>

<p>As some may remember the price of gas seems to go up based on what</p>
<p>people hear on the news, is this just a fantastic coincidence?</p>
<p>It just seems to be such a strange fact that when you see on the nightly news</p>
<p>that Gas prices are going up, the next day, guess what, the price goes up. </p>
<p>So what are we looking at here, a loss of common sense or are we just loosing our</p>
<p>ability to compete in the market place. </p>
<p>The fact remains that if you own a business and you are currently paying through the nose for </p>
<p>gas and or diesel then you are going to be paying a lot more soon, so can you afford to deal with </p>
<p>all these people who are price fixing the price of fuel?</p>
